Razer Settles FTC Lawsuit for Deceptive Marketing

Razer has reached a settlement with the Federal Trade Commission (FTC) regarding misleading advertising of its Razer Zephyr mask, which was launched in late 2021. The company has been fined $100,000 and is required to pay back a total of $1,071,254.33 to consumers. The FTC will issue refunds to 6,764 buyers who purchased the mask under false pretenses.

Consumers who bought the Zephyr mask will receive a full refund of $99.99 for the mask and filters, while those who purchased the Starter Pack will get $150. The FTC has issued warnings against scams posing as representatives asking for payment or personal information for refunds. Buyers should cash refund checks within 90 days or redeem PayPal payments within 30 days.

Misleading Claims

The controversy arose from Razer's claims that the Zephyr mask had “replaceable N95 grade filters for maximum protection” and was “FDA-registered and lab-tested for 99 percent BFE.” These claims misled consumers to believe the mask provided the same level of protection as certified N95 masks. An executive at Razer raised concerns about the marketing language, questioning its accuracy.

Testing and Efficacy

Third-party tests revealed that, although the Zephyr mask contained N95 filters, it did not meet the necessary standards for certification. The best performance recorded was only 86.3% effectiveness with the fans on, which was below the expected efficacy for N95 masks. This led to a false sense of security for buyers who relied on these claims.

Consumer Experience

Despite Razer's efforts to rectify the situation by removing N95 mentions from their marketing, the damage was done. Many consumers reported difficulties in obtaining refunds, with only 6% receiving their money back initially. The FTC has since stepped in to facilitate the refund process for all affected customers.
