McKinsey, the renowned global consulting group, has agreed to pay $650 million to settle a criminal investigation by the United States regarding its advisory role for Purdue Pharma in boosting OxyContin sales. This settlement emerges amid a larger corporate crackdown on the marketing of addictive painkillers that have contributed to the devastating opioid epidemic.

The consultancy faces serious accusations, including conspiracy to misbrand a drug and obstruction of justice. Under a five-year deferred prosecution agreement with the US Department of Justice, McKinsey will avoid criminal charges if it adheres to specific conditions, such as ceasing all work related to the sale and marketing of controlled substances.

Key Insights from the Case

Prosecutors revealed that McKinsey provided Purdue with strategies to "turbocharge" OxyContin sales. Additionally, Martin Elling, a former senior partner at McKinsey, has agreed to plead guilty to charges of obstruction of justice for destroying documents linked to the consultancy's dealings with Purdue. Elling is scheduled to enter his plea on January 10.

In a statement, McKinsey expressed regret over its past services to Purdue Pharma, acknowledging the societal harm caused by opioids. The firm emphasized that it should have recognized the repercussions of its actions and stated:

“This terrible public health crisis and our past work for opioid manufacturers will always be a source of profound regret for our firm.”

Since 2021, McKinsey has settled nearly $1 billion related to its opioid advisory work, including a $640 million settlement with all 50 states. Notably, McKinsey has committed to no longer advising clients involved in opioid-related businesses.

Purdue Pharma's Legal Troubles

Purdue Pharma itself pleaded guilty to criminal charges in 2020 over its marketing practices for OxyContin, which included conspiracy to defraud officials and bribery. The company is currently involved in court-ordered mediation concerning an $8.3 billion settlement stemming from its bankruptcy.

The Sackler family, owners of Purdue, has also agreed to pay ÂŁ225 million in civil penalties while denying any wrongdoing.

Since the onset of the opioid crisis in 1999, over 500,000 deaths in America have been attributed to opioid overdoses. McKinsey concluded its statement by noting that this settlement marks a significant step in addressing its past mistakes and enhancing its risk management processes to prevent similar issues in the future.
